ONLINE BANKING ENROLLMENT AGREEMENT

Welcome to The First National Bank of Hope’s Online Banking enrollment.

The First National Bank of Hope’s Online Banking Enrollment Agreement (“Agreement”) governs use of The First National Bank of Hope’s Online Banking Service. As used in this document, the words “you” and “your” refer to The First National Bank of Hope’s customer(s) and their use of the Service. The words “we” and “our” refer to The First National Bank of Hope (“FNB”).

INTRODUCTION – This Agreement explains the terms and conditions governing the online Internet banking service offered through The First National Bank of Hope. By using the Service, you agree to the terms and conditions of this Agreement. The terms and conditions of the deposit agreements and disclosures for each of your accounts held at The First National Bank of Hope as well as any other agreements with The First National Bank of Hope, such as for loans, etc., continue to apply notwithstanding anything to the contrary in this Agreement. This Agreement will be governed by and interpreted in accordance with Federal laws and regulations, or to the extent there is no applicable Federal law or regulation, by the laws of the State of Kansas. By accepting below or otherwise using the Service, you agree to use the Service only for bona fide and lawful purposes permitted under this Agreement.

INTERNET BROWSER REQUIREMENT – For your privacy and protection, The First National Bank of Hope requires your browser to support 128-bit encryption. If you do not know how your browser is set, please contact your browser supplier and ask them for instructions on setting your browser for 128-bit encryption. You are responsible for the installation, maintenance, and operation of your computer and your browser software. Online Banking supports the latest versions of Internet Explorer, Chrome, Foxfire and Safari. The risk of error, failure, or non-performance is your personal risk and includes, but is not limited to, the risk that you do not operate your computer or your software properly. The First National Bank of Hope is not responsible for any problems related to any electronic viruses that may infect your system. The First National Bank of Hope makes no warranty to you regarding your computer or your software.

ACCESS – To use this Service, you must have an account with The First National Bank of Hope and have access to Internet services. Once you have accepted this Agreement, we will send you by postal service or secure email confirmation of your enrollment along with an assigned User ID and a temporary password.


EMAIL – Email is provided, so you can ask questions about your account(s) and for general feedback. Secure email is accessible after you login to The First National Bank of Hope’s Online Banking. Email transmissions outside of the Online Banking site are not secure. To ensure the security of your account information, we request you use the secure email within Online Banking when asking specific questions about your account(s). Email cannot be used to initiate transactions on your account(s). You should not rely on general or public email for banking transactions; you must use the appropriate functions within FNB or call the bank.

STOP PAYMENTS – If you wish to put a Stop Payment order on a check that you have written or an automatic payment you have previously authorized you must call or come into the bank. Stop payment orders cannot be requested via email.

PASSWORD – You will be given a temporary password and User ID to access your accounts at The First National Bank of Hope. For security purposes, you will be required to change your password and setup a new User ID when you initially login. Your new password will be determined by you and will not be accessible by The First National Bank of Hope. Your password is case sensitive and must be at least 8 characters in length and contain at least 1 alpha and 1 numeric character. Your User ID is not case sensitive and must be at least 6 characters in length and contain at least 1 alpha, 1 numeric and 1 special character. You are responsible for keeping your password, account number(s) and other account information confidential. You also agree to change your password regularly. You agree not to give or make available your password or other means to access your account to any unauthorized individuals. If you permit other persons to use the Service or your password or other means to access your account, you are responsible for any transactions they authorize.

Upon three (3) unsuccessful attempts to use your password or three (3) wrong responses to security questions your access to FNB Online Banking will be revoked. To re-establish your authorization to use FNB Online Banking, to report that your password may have been lost or stolen, or to report that someone has transferred or may transfer money from your account without your permission, immediately notify The First National Bank of Hope, at (785) 366-7225 in the Hope area, (785) 427-2232 in the Miltonvale area, or toll free at (800) 747-2334 or (800) 428-3033.

SECURITY – Your role in preventing misuse of your account(s) is extremely important. Examine your statements promptly upon receipt. If you find that your records and The First National Bank of Hope’s disagree, immediately call us. In addition to protecting your account information, you agree to take precautions to protect your personal identification information, such as your driver’s license, social security number etc. This information by itself or together with information on your account(s) may allow unauthorized access to your account(s). You agree to notify The First National Bank of Hope immediately if you believe another person has improperly obtained your password.

SERVICES - With online banking, you can manage your account(s) from your home or office on your personal computer or from your mobile device. You can view account balances and transaction histories, view statements and check images, transfer money between your accounts, (as noted in the applicable account deposit agreement and disclosure statement), set up personal reminders, request a change to customer information we have on file, change your password, track your online banking activity, pay bills and/or communicate directly with The First National Bank of Hope through secure email.

MOBILE BANKING - Sign up for Mobile Banking to view account balances and history, initiate transfers between your accounts, make loan payments, pay bills and receive account alerts all from your cell phone or mobile device with Internet access. Mobile Banking is free to all Online Banking users. This service is available by clicking on the Mobiliti link to enroll or by downloading the Touch Banking App and entering the banks App Code - FNBHopeKS.

BILL PAY - Bill Pay Service allows customers to pay bills or make payments directly from their checking account via the Internet. This service is available by clicking on the Bill Pay link, completing the enrollment form and agreeing to the terms and conditions.

FEES & CHARGES – There are currently no additional fees for accessing your account(s) through The First National Bank of Hope Online Banking Service. Refer to the Truth-In-Savings Disclosure for the fee schedule for your type of account.

BILL PAY FEES – Use of the Bill Pay feature is optional. Persons enrolling in Bill Pay must agree to the terms and conditions of the Bill Pay Service prior to enrolling. Bill Pay is FREE for 3 months and will remain free with a minimum of three (3) transactions per calendar month. A $4.95 monthly fee after 3 months will be charged when Bill Pay transactions number less than three (3) in any calendar month. Fees will reflect on your monthly statement. Additional per transaction fees may apply for special services. Bill Pay Services may be cancelled at anytime by notifying the bank.

OVERDRAFTS – If your account has insufficient funds to perform all electronic funds transfers (ATM withdrawals, pre-authorized transactions, debit card transactions, online banking transfers, etc.) requested for a given business day, then certain electronic funds transfers involving currency disbursement, like ATM withdrawals, will have priority, and the electronic funds transfers initiated through this service may result in overdrawing your account and/or may, at The First National Bank of Hope’s discretion and without prior notification to you, be canceled. In addition, all overdraft charges that apply will be debited from your account.

DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY - The First National Bank of Hope makes no warranty of any kind, expressed or implied, including any implied warranty of merchantability or fitness for a particular purpose, in connection with the internet banking services provided to you under this Agreement. We do not and cannot warrant that The First National Bank of Hope will operate without errors or that any or all online services will be available and operational at all times. Except as specifically provided in the Agreement or where the law requires a different standard, you agree that neither we, or the service providers, shall be responsible for any loss, property damage, or bodily injury whether caused by the equipment, software, Internet browser providers, Internet access providers, online service providers, or by an agent or subcontractor of any of the foregoing. We or the service providers shall not be responsible for any direct, indirect, special, consequential, economic or other damages arising in any way out of the installation, use or maintenance of the equipment, software, online financial services, or Internet browser or access software.

HOURS OF ACCESS – You can access your account(s) at The First National Bank of Hope through this Service seven days a week, 24 hours a day. However, at certain times, some or all of the online banking may not be available due to system maintenance or other problems.

POSTING OF TRANSFERS – A transfer initiated on a business day through this Service before 3:00 p.m. Central Time will be posted to your account the same day. All transfers completed after 3:00 p.m. Central Time or on a Saturday, Sunday or banking holiday will be posted the next business day.

TRANSFERRING FUNDS – Transfers may be subject to limitations based on individual account types as outlined in the Truth-In-Savings Disclosure.

OBTAINING ACCOUNT BALANCES AND TRANSACTION HISTORIES – You can obtain balances and transaction histories on all eligible accounts. Current balance and activity information is available after 6 p.m. on business days.

CHANGES IN TERMS - We reserve the right to change any terms or conditions described in this Agreement. We may send any notice of change to you via email and you will be deemed to have received it three days after it is sent. The revised terms and conditions shall be effective at the earliest date allowed by applicable law. We reserve the right to terminate this Agreement and your use of the Services in whole or in part at any time without prior notice.

YOUR RIGHT TO TERMINATE - You may cancel your service at any time by providing us with a written notice sent by postal mail to The First National Bank of Hope, P.O. Box 67, Hope, KS 67451 – Attention: Online Banking Customer Service; or by fax at (785) 366-7333. Within three (3) business days of receiving instructions, your access to online banking will be suspended. You may also cancel your service by calling (785) 366-7225 or (800) 747-2334 Toll Free.

OUR RIGHT TO TERMINATE – Your online banking access may be canceled by The First National Bank of Hope at any time, without prior notice and for any reason. After cancellation, online banking services may be reinstated at The First National Bank of Hope’s discretion. To reinstate your service, call us at (785) 366-7225 or (800) 747-2334 Toll Free. If you do not access The First National Bank of Hope’s Online Banking for a one-year period, FNB reserves the right to disconnect your service without notice.

CONSENT TO ELECTRONIC DELIVERY OF NOTICES – By accepting below or by otherwise using the service, you also agree that any and all disclosures and communications regarding the service between you and The First National Bank of Hope, including this Agreement, may be made electronically by posting to The First National Bank of Hope’s website in accordance with applicable law. Any electronic disclosure or communication we make will be considered made when transmitted by The First National Bank of Hope and any disclosure or communication we make by posting to our website will be considered made when posted by The First National Bank of Hope.
