|ONLINE BANKING ENROLLMENT AGREEMENT
Welcome to First National Bank of Hope’s On-Line Banking enrollment.
First National Bank of Hope Online Banking Enrollment Agreement (“Agreement”) governs use of the First National Bank of Hope On-line Banking Service. As used in this document, the words “you” and “your” refer to First National Bank of Hope’s customer(s) and their use of the Service. The words “we” and “our” refer to First National Bank of Hope (“FNB”).
INTRODUCTION – This Agreement explains the terms and conditions governing the On-Line Internet Banking Service offered through First National Bank. By using the Service, you agree to the terms and conditions of this Agreement. The terms and conditions of the deposit agreements and disclosures for each of your accounts held at First National Bank as well as any other agreements with First National Bank, such as for loans, etc., continue to apply notwithstanding anything to the contrary in this Agreement. This Agreement will be governed by and interpreted in accordance with Federal laws and regulations, or to the extent there is no applicable Federal law or regulation, by the laws of the State of Kansas. By accepting below or otherwise using the Service, you agree to use the Service only for bona fide and lawful purposes permitted under this Agreement.
INTERNET BROWSER REQUIREMENT – For your privacy and protection, First National Bank requires your browser to support 128-bit encryption. If you do not know how your browser is set, please contact your browser supplier and ask them for instructions on setting your browser for 128-bit encryption. A Link to Microsoft Internet Explorer's download site is provided on the login page for the Service. You are responsible for the installation, maintenance, and operation of your computer and your browser software. The risk of error, failure, or non-performance is your personal risk and includes, but is not limited to, the risk that you do not operate your computer, or your software properly. First National Bank is not responsible for any problems related to electronic virus(es) that may infect your system. First National Bank makes no warranty to you regarding your computer or your software.
ACCESS – To use this Service, you must have a First National Bank account and have access to Internet services. Once you have accepted this Agreement, we will send you by postal service, confirmation of your enrollment along with an assigned temporary User ID and password.
E-MAIL – E-mail is provided, so you can ask questions about your account(s) and for general feedback. E-mail is accessible after you login to First National Bank(FNB).
E-mail transmissions outside of the On-line Banking site are not secure. We advise you not to send or ask us for sensitive information such as account numbers, password, account information, etc. via any general or public e-mail system. Therefore, to ensure the security of your account information, you are required to use the secure e-mail within our FNB system when asking specific questions about your account(s). E-mail cannot be used to initiate transactions on your account(s). You should not rely on general or public e-mail for banking transactions; you must use the appropriate functions within FNB or call the bank.
STOP PAYMENTS – If you wish to put a Stop-Payment order on a check that you have written or an automatic payment you have previously authorized you must call or come into the bank. Stop-payment orders cannot be requester via e-mail.
YOUR PASSWORD – You will be given a temporary password and User ID to access your First National Bank account(s). For security purposes, you will be required to change your password and setup a new User ID when you initially login. Your new password will be determined by you and will not be accessible by First National Bank. Your password is case sensitive and must be at least 8 characters in length. It must consist of alpha,1 special and 1 numeric character. Your User ID must also be at least 6 characters in length and contain at least 1 alpha and 1 numeric character. The User ID is not case sensitive. You are responsible for keeping your password, account number(s) and other account information confidential. You also agree to change your password regularly. You agree not to give or make available your password or other means to access your account to any unauthorized individuals. If you permit other persons to use the Service or your password or other means to access your account, you are responsible for any transactions they authorize.
Upon three (3) unsuccessful attempts to use your password, your access to FNB online banking will be revoked. To re-establish your authorization to use FNB online banking, to report that your password may have been lost or stolen, or to report that someone has transferred or may transfer money from your account without your permission, immediately notify First National Bank, at (785) 366-7225 in the Hope area, or (800) 747-2334 Toll Free.
SECURITY – Your role in preventing misuse of your account(s) is extremely important. Examine your statements promptly upon receipt. If you find that your records and First National Bank’s disagree, immediately call us. In addition to protecting your account information, you agree to take precautions to protect your personal identification information, such as your driver’s license, social security number etc. This information by itself or together with information on your account(s) may allow unauthorized access
to your account(s). You agree to notify First National Bank immediately if you believe another person has improperly obtained your password.
SERVICES - With On-line Banking, you can manage your account(s) from your home or office on your personal computer. You can view account balances and transaction histories, transfer money between your accounts, (as noted in the applicable account deposit agreement and disclosure statement), order U.S. Savings Bonds, set up personal reminders, request a change to customer information we have on file, change your password, track your online banking activity, and/or communicate directly with First National Bank through secure e-mail.
MOBILE BANKING - Sign up for Mobile Banking to view account balances and history, initiate transfers between your accounts, make loan payments and receive account alerts all from your cell phone or mobile device with Internet access. Mobile Banking is free to
all On-Line Banking users; just click on the Mobile link to enroll.
BILL PAY - Bill Pay Service allows customers to pay bills or make payments directly from their checking account via the Internet. This Servise is available by clicking on the Bill Pay link, completing the separate Bill Pay Enrollment form and agreeing to the terms and conditions; just click on the Bill Pay link to enroll.
BILL PAY FEES - Use of the Bill Pay feature is optional. Persons enrolling in Bill Pay must agree to the terms and conditions of the Bill Pay Service prior to enrolling. Bill Pay is free for three (3) months and will remain free with a minimum of three(3) transactions per calendar month. A $4.95 monthly fee after three(3) months will be charged when Bill Pay transactions number less than three(3) in any calendar month. Fees will reflect on your monthly statement. Bill Pay Services may be cancelled at anytime by notifying the Bank.
FEES & CHARGES – There are currently no additional fees for accessing your account(s) through First National Bank On-Line Banking Service. Refer to the Truth-In-Savings Disclosure for the fee schedule for your type of account.
OVERDRAFTS – If your account has insufficient funds to perform all electronic funds transfers (ATM withdrawals, pre-authorized transactions, debit card transactions, online banking transfers, etc.) requested for a given business day, then certain electronic funds transfers involving currency disbursement, like ATM withdrawals, will have priority, and the electronic funds transfers initiated through this service may result in overdrawing your account and/or may, at First National Bank’s discretion and without prior notification to you, be canceled. In addition, all overdraft charges that apply will be debited from your account.
DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY - First National Bank makes no warranty of any kind, expressed or implied, including any implied warranty of merchantability or fitness for a particular purpose, in connection with the On-Line Banking services provided to you under this Agreement. We do not and cannot warrant that First National Bank will operate without errors or that any or all online services will be available and operational at all times. Except as specifically provided in the Agreement or where the law requires a different standard, you agree that neither we, or the service providers, shall be responsible for any loss, property damage, or bodily injury whether caused by the equipment, software, Internet browser providers, Internet access providers, online service providers, or by an agent or subcontractor of any of the foregoing. Nor shall we or the service providers be responsible for any direct, indirect, special, consequential, economic or other damages arising in any way out of the installation, use or maintenance of the equipment, software, online financial services, or Internet browser or access software.
HOURS OF ACCESS – You can access your First National Bank account(s) through this Service seven days a week, 24 hours a day. However, at certain times, some or all of the online banking may not be available due to system maintenance or other problems.
POSTING OF TRANSFERS – A transfer initiated on a business day through this Service before 3:00 p.m. Central Time is posted to your account the same day. All transfers completed after 3:00 p.m. Central Time or on a Saturday, Sunday or banking holiday will be posted the next business day.
TRANSFERRING FUNDS – Transfers may be subject to limitations based on individual account types as outlined in the Truth-In-Savings Disclosure.
OBTAINING ACCOUNT BALANCES AND TRANSACTION HISTORIES – You can obtain balances and transaction histories on all eligible accounts. Current balance and activity information is available after 6 p.m. on business days.
CHANGES IN TERMS - We reserve the right to change any terms or conditions described in this Agreement. We may send any notice of change to you via e-mail and you will be deemed to have received it three days after it is sent. The revised terms and conditions shall be effective at the earliest date allowed by applicable law. We reserve the right to terminate this Agreement and your use of the Services in whole or in part at any time without prior notice.
YOUR RIGHT TO TERMINATE - You may cancel your service at any time by providing us with a written notice set by postal mail to First National Bank, P.O. Box 67, Hope, KS 67451 – Attention: Online Banking Customer Service; or by fax at (785) 366-7333. Within three (3) business days of receiving instructions, your access to online banking will be suspended. You may also cancel your service by calling (785) 366-7225 or (800) 747-2334 Toll Free.
OUR RIGHT TO TERMINATE – Your online banking access may be canceled by First National Bank at any time, without prior notice and for any reason. After cancellation, online banking services may be reinstated at First National Bank’s discretion. To reinstate your service, call us at (785) 366-7225 or (800) 747-2334 Toll Free. If you do not access your First National Bank account(s) through our internet banking for a one-year period, FNB reserves the right to disconnect your service without notice.

CONSENT TO ELECTRONIC DELIVERY OF NOTICES – By accepting below or by otherwise using the service, you also agree that any and all disclosures and communications regarding the service between you and First National Bank, including this Agreement, may be made electronically by posting to the First National Bank web site in accordance with applicable law. Any electronic disclosure or communication we make will be considered made when transmitted by First National Bank, and any disclosure or communication we make by posting to our web site will be considered made when posted by First National Bank.
