Agreement and Disclosures
This Internet Banking and Bill Pay agreement and disclosure describes your rights and responsibilities as a user of these services. It also describes the rights and responsibilities of County Bank. In this agreement, "you" and "your" refers to those who sign the Membership Application or any Internet Banking authorization form or authorized representative. "We,” "us,” or "our" refers to County Bank. The word "account" means any one or more share or loan accounts you have with County Bank. By requesting and using the Internet Banking and/or Bill Pay, you agree to comply with the terms and conditions of this agreement.
County Bank will provide instructions on how to use the Internet Banking and/or Bill Pay. You will gain access to your accounts through the use of your internet-enabled computer, your ISP, your password and your user ID. You are responsible for the installation, maintenance, and operation of your computer. County Bank will not be responsible for any errors or failures involving any telephone service or your computer. Available balance is NOT updated in real time and may not reflect all account activity, including any outstanding credits or debits. Recent Activity information is updated through-out the day and may not match your Available Balance information
A. At the present time, you may use the Internet Banking and/or Bill Pay to:
a. Review account balance and transaction history of your savings, checking, and loan accounts.
b. Transfer funds among savings, checking, and loan accounts.
c. Review information on your loan accounts.
d. Make bill payments and preauthorized transfers from your checking account.
Transactions involving your deposit accounts will be subject to the terms of your membership and account agreement.
B. County Bank offers the benefits and convenience of the Internet Banking and Bill Pay service to you free. If Bill Pay is not used of a period of 60 continuous days then you will be removed from enrollment.
C. You will continue to receive regular account statements via the mail either monthly or quarterly, depending on the type of account.
D. You are responsible for keeping your password and the Internet Banking and/or Bill Pay account information confidential. In order to protect yourself against fraud, you should adhere to the following guidelines:
• Do not give out your account information, password, or user ID
• Do not leave your PC unattended while you are in County Bank’s Internet Banking and/or Bill Pay site
• Never leave your account information within visible range of others
• Do not send privileged account information (account number, password, etc.) in any public or general e-mail system
If you believe your password has been lost or stolen or if you suspect fraudulent activity on your account, call County Bank at 660-548-3137 or 660-263-7100 during regular business hours. If you notify us within two (2) business days after you learn of the loss or theft of your password, your liability will not exceed $50.00 should someone use your password without your permission. If you do NOT notify us within two (2) business days after the loss or theft of your password, your liability could be as much as $500.00, if we establish that the use of your password could have been prevented had we been notified within that two-day period.
If your statement shows Internet Banking and/or Bill Pay transfers that you did not make, tell us at once. If you do not tell us within sixty (60) days after the statement was mailed to you, you will be liable for the full amount.
If you believe your password has been lost or stolen, please use the password change feature within the Internet Banking and/or Bill Pay section of the web site to change your password.
E. If you send County Bank an e-mail message, we will be deemed to have received it on the following business day. You should not rely on e-mail if you need to report an unauthorized transaction from one of your accounts or if you need to stop a payment that is scheduled to occur. Note: E-mail transmissions outside of the online site are not secure. We advise you not to send us or ask for sensitive information such as account numbers, passwords, account information, etc. via any general or public e-mail system. If you wish to contact us electronically, please use the Guest Book provided in our Internet Banking site. Use this secure form to e-mail County Bank regarding inquiries about an electronic funds transfer error resolution, reporting unauthorized transactions, or contact County Bank regarding other concerns of a confidential nature.
F. For purposes of transactions, County Bank’s business days are Monday through Friday, excluding holidays and Sundays. All Internet Banking and/or Bill Pay transaction requests received after 2:00 pm Monday through Friday and all transactions which are requested on Sundays or holidays on which County Bank is closed will be processed on the next business day. County Bank’s business day begins at 8:00 am Monday through Friday.
G. Bill Pay service permits you to use your internet-enabled computer to direct payments from your designated bill payment account to third parties you wish to pay. Your bill payment account must be a checking account. All payments you make will be deducted from the checking account that you designate as your bill payment account for the bill payment service. Any payments you wish to make through this service must be payable in U.S. dollars to a payee located in the continental United States.
You may authorize new payment instructions or edit previously authorized payment instructions for Bill Pay that are either variable (i.e. payments on merchant charge accounts that vary in amount) or fixed (i.e. fixed mortgage payments). When you transmit a bill payment instruction to us, you authorize us to transfer funds to make the bill payment transaction from your checking account. We reserve the right to restrict types of payees to whom payments may be made using the service from time to time.
County Bank will not process any bill payment transfer if we know the required transaction information is incomplete. County Bank will not be liable for any transaction that contains incorrect information that we were not responsible for entering or knowing. If there are insufficient funds in your account to make the bill payment request, we will refuse to make the payment. County Bank reserves the right to refuse to process payments instructions that reasonably appear to us to be fraudulent or erroneous. County Bank will withdraw the designated funds from your account for the bill payment transfer by midnight, the night before the scheduled processing date.
It is your responsibility to schedule your bill payment in such a manner that your obligations will be paid on time. You should enter and transmit your bill payment instructions at least seven (7) days before a bill is due. You are responsible for any late payments or finance charges that may be imposed as a result of your failure to transmit a timely bill payment authorization.
You may cancel or stop payment on variable or fixed bill payment instructions under certain circumstances. If you discover an error in or want to change a payment instruction (i.e. payment date or payment amount) for a variable or fixed payment that you have already scheduled for transmission through the Bill Pay service, you may electronically edit or cancel your payment request through the Internet Banking and/or Bill Pay. Your cancellation request must be entered and transmitted through the Internet Banking and/or Bill Pay service before the date you have scheduled for payment. If your request is not entered on time, you will be responsible for the payment.
If you wish to stop payment on a fixed or variable bill payment transaction, not using the Internet Banking and/or Bill Pay service, County Bank must receive your oral stop payment request at least three (3) business days before the payment is scheduled to be made. You may call County Bank at 660-548-3137or 660-263-7100 to request a stop payment (applicable fees will apply). If you call, we may require you to confirm your stop payment request in writing within fourteen (14) days after the call.
H. We will disclose information to third parties about your account or the transfers you make as necessary to complete transfers; to verify the existence of sufficient funds to cover specific transactions upon the request of a third party, such as a credit bureau or merchant; to comply with government agency or court orders; and if you give us your express permission.
I. Our liability to you extends only to the extent that our liability has not been separately disclosed by any other agreements, notices, or disclosures. In no event shall we be liable to you for failure to provide access to your Internet Branch and/or Bill Pay services accounts. Unless otherwise required by applicable law, we are only responsible for performing the Internet Banking and/or Bill Pay services as delineated in this agreement. We will be liable for the amount of any material losses or damages incurred by you resulting directly from our gross negligence.
We will not be liable to you in the following instances:
0. If through no fault of County Bank, you do not have enough money in your account to make the transfer, your account is inactive or the transfer would go over the credit limit on your line of credit, if applicable;
1. If circumstances beyond our control (such as fire, power outage, equipment or technical failure or breakdown) prevents the transfer despite reasonable precautions that we have taken;
2. If there is a hold on your account, or if access to your account is blocked, in accordance with our policies;
3. If you used the wrong password or you have not properly followed any applicable computer or credit union user instructions for making transfer and bill payment transactions;
4. If you believe someone has accessed your accounts without your permission and you fail to notify us immediately;
5. If we have received incomplete or inaccurate information from you or a third party involving the account or transfer;
6. If we have a reasonable basis for believing that unauthorized use of your password or account has occurred or may be occurring or if you default under this agreement, the deposit account agreement, a credit agreement, or any other agreement with us, or if we or you terminate this agreement
7. If, through no fault of ours, a bill payment or funds transfer transaction does not reach a particular creditor and a fee, penalty, or interest in assessed against you;
8. If the error was caused by a system beyond County Bank’s control such as a telecommunications system or internet service provider; and
9. If there are other exceptions as established by County Bank
In no event shall we have any liability to you or any third party for any indirect, special, or consequential damages resulting from or arising out of this agreement.
J. You agree that we may terminate this agreement and your electronic fund transfer services, if you, or any authorized user of the Internet Banking and/or Bill Pay services or password breach this or any other agreements with us; or if we have reason to believe that there has been an unauthorized use of your accounts or password. In addition, we reserve the right to terminate the service if you fail to use the service for more than three consecutive billing cycles. If your account is considered inactive, you must contact us to have the service activated before you will be able to schedule any transactions through the service.
You or any other party to your account can terminate this agreement by notifying us in writing or by e-mail. Termination of service includes any prescheduled bill payments made through Bill Pay will also be terminated. Your final charge for the bill payment service will be assessed at the end of your statement cycle.
